These Terms of Service ("Terms") govern your access to and use of anaerobic-coffees.com (the "Site") and any products or services offered by Anaerobic Coffees LLC, a New Jersey limited liability company ("Anaerobic," "we," "us," or "our").

By placing an order, creating an account, or starting a subscription, you agree to these Terms. If you do not agree, please do not use the Site.

Please read Sections 16 and 17 carefully — they affect your legal rights. Disputes are resolved individually in New Jersey courts, you and Anaerobic each waive participation in class actions to the fullest extent permitted by law, and both of us agree to try to resolve any dispute informally first.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order or create an account. By using the Site you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us immediately at contact@anaerobic-coffees.com if you suspect unauthorised use. We may suspend or close accounts that violate these Terms.

3. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to systems, accounts, or data.
  • Interfere with the operation of the Site, including denial-of-service activity, abusive crawling, or bypassing security controls.
  • Reverse-engineer, scrape, or copy substantial portions of the Site.
  • Transmit viruses, malware, or harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Purchase our products for resale or commercial redistribution without our prior written permission. Wholesale customers operate under a separate written agreement.
  • Use multiple accounts, addresses, or payment methods to obtain promotions, guarantees, gifts, or referral rewards more than the stated limit.

4. Orders, order acceptance, pricing, and payment

Your order is an offer. Placing an order is an offer to buy. No contract is formed until we accept your order by shipping it or by sending a shipping confirmation. We may accept or decline any order, in whole or in part, at our discretion — including for product availability, suspected fraud, suspected resale, quantity limits, or pricing errors.

Quantity limits. We may limit or cancel quantities purchased per person, per household, per address, or per order, and may limit or refuse orders that in our judgment appear to be placed by dealers, resellers, or distributors.

Pricing. Prices are shown in US dollars and are subject to change. Sales tax is calculated at checkout based on your shipping address.

Pricing errors. Despite our efforts, products may occasionally be listed at an incorrect price or with incorrect information. We reserve the right to cancel any order arising from a pricing or description error, even after the order is confirmed, and to refund any amount charged in full. Your sole remedy in that case is a full refund of what you paid.

Payment. By submitting an order you authorise us to charge the payment method you provide for the total order amount, including taxes and shipping. If a charge is declined or reversed, we may cancel or hold the order.

Fraud. If we reasonably believe an order involves a stolen or unauthorised payment method or other fraud, we may cancel the order, close the account, and take any other action available to us under law.

Changes and cancellations. Because every order is roasted to order, orders cannot be changed or cancelled once they have entered production. See Section 5 and our Shipping Policy for the cut-off rules.

5. Subscriptions and automatic renewal

YOUR SUBSCRIPTION CONTINUES AND RENEWS AUTOMATICALLY UNTIL YOU CANCEL IT.

By starting a subscription you expressly authorise Anaerobic Coffees LLC to charge the payment method on file, on a recurring basis, at the plan price and billing frequency shown at checkout, until you cancel.

  • Monthly plans bill and ship once per month.
  • Prepaid 3-month plans bill once per 3-month term, in advance, covering the three monthly deliveries in that term, and renew automatically for successive 3-month terms at the then-current price unless cancelled.
  • You may skip, pause, change, or cancel at any time, free of charge, with no minimum commitment, from your account's subscription manager or by emailing contact@anaerobic-coffees.com.
  • To avoid the next charge, cancel before your next scheduled billing date. Changes made at least 24 hours before that date take effect for the next delivery.
  • Once we send you the processing confirmation for a delivery, that order is being roasted and can no longer be changed, cancelled, or recalled. It is then subject to our Refund and Returns Policy like any other order.
  • We will email you a reminder before each prepaid-term renewal, and at least once a year for every active subscription, identifying the plan, the amount and frequency of charges, and how to cancel.
  • If we change your subscription price, we will give you advance notice by email before the change takes effect, and the new price will apply only from your next renewal. You may cancel before then.
  • If a payment fails, we will email you and retry. After repeated failures the subscription pauses until you update your payment method.
  • Gift cards and store credit cannot be used as the recurring payment method for a subscription.

6. Promotions, discounts, gifts, and referrals

Promotional codes, welcome offers, included gifts (such as brewing kits or samples), gifts tied to order thresholds, and referral rewards are governed by our Promotions, Gift Card, and Referral Terms, incorporated by reference. In summary: offers are limited to one per customer unless stated otherwise, cannot be combined, apply only to the order or term stated, and may be withdrawn, voided, or clawed back if obtained through duplicate accounts or other abuse.

7. Shipping, delivery, and risk of loss

Shipping methods, costs, and estimated delivery windows are described in our Shipping Policy, incorporated by reference. Title and risk of loss pass to you when the carrier accepts the package from us. Delivery estimates are provided by carriers and are not guaranteed.

8. Returns and refunds

Returns and refunds are governed by our Refund and Returns Policy, incorporated by reference. Because roasted coffee is a perishable food product, that policy is more limited than a typical retailer's.

9. Product information, food, and health

Our coffee is a roasted agricultural product. Colour, density, and flavour vary naturally between lots and harvests, and roast dates, tasting notes, cupping scores, and brewing recommendations are provided as guidance — individual palates, water, grinders, and brewing equipment vary.

Allergens. Our coffee is a single-ingredient product — roasted coffee beans, nothing added — and contains none of the major food allergens defined by US law. If you have a severe allergy, contact us before ordering.

Caffeine. Coffee contains caffeine. If you are pregnant or nursing, take medication, or have a medical condition affected by caffeine, consult your healthcare provider about your intake.

No health claims. We sell coffee as coffee. Nothing on the Site is medical advice, and we make no claim that our products diagnose, treat, cure, or prevent any disease.

10. Reviews, testimonials, and user content

If you submit reviews, comments, photographs, or other content ("User Content"), you keep ownership of it. You grant Anaerobic Coffees LLC a non-exclusive, royalty-free, worldwide, sublicensable licence to use, reproduce, adapt, and display that content in connection with our business, including in marketing, with attribution to the name or handle you submitted.

You represent that your User Content is yours to submit and does not infringe anyone's rights.

Nothing in these Terms restricts your right to review us honestly. We do not prohibit, penalise, or charge you for publishing an honest review of our products or service, and we do not require you to transfer ownership of your review to us. We may remove content that is unlawful, defamatory, harassing, obscene, off-topic, spam, or that contains someone's personal information or trade secrets — applied evenly to positive and negative content alike. 11. Intellectual property

All content on the Site — text, graphics, photography, logos, brand marks, designs, and software — is owned by or licensed to Anaerobic Coffees LLC and protected by United States and international law. You may use the Site only as expressly permitted; no other rights are granted.

"Anaerobic" and our logos are trademarks of Anaerobic Coffees LLC. You may not use them without our prior written permission.

12. Third-party links and services

The Site links to and integrates third-party services (payments, shipping, analytics, reviews, marketing). We are not responsible for third-party content, products, or practices. Your dealings with third parties are between you and them.

13. Disclaimers

To the fullest extent permitted by law, the Site and our products are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

14. Limitation of liability

To the fullest extent permitted by law, Anaerobic Coffees LLC and its officers, members, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Site or our products, even if advised of the possibility.

Our total cumulative liability for all claims arising out of or relating to the Site or our products will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred US dollars ($100).

New Jersey residents: the exclusions and limitations in Sections 13, 14, and 15 do not apply to you to the extent New Jersey law prohibits them. All other provisions of these Terms remain in full effect. Nothing in these Terms limits liability for fraud, personal injury caused by our negligence, or any other liability that cannot be limited by law.

15. Indemnification

You agree to indemnify and hold harmless Anaerobic Coffees LLC from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party right.

16. Governing law, courts, and class-action waiver

These Terms and any dispute arising from them are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. The state and federal courts located in Hudson County, New Jersey have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction there. Either of us may bring an individual claim in small-claims court if it qualifies.

You and Anaerobic each waive the right to bring or participate in a class action, collective action, or representative action, to the fullest extent permitted by law. New Jersey residents: nothing in this section limits any right that New Jersey law does not permit to be limited.

17. Informal dispute resolution — required first step

Before starting any lawsuit, you and Anaerobic each agree to try to resolve the dispute informally for 60 days. Send a written Notice of Dispute to contact@anaerobic-coffees.com with the subject "Notice of Dispute," including your name, the email address on your account, order number(s), a description of the dispute, and the relief you want. We will do the same for any claim we have against you. Either of us may request a telephone or video conference. This step is a condition of starting a formal proceeding, and any deadline to bring a claim is paused while it runs. Most problems are solved here.

18. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including acts of God, severe weather, war, terrorism, epidemics, fire, flood, crop failure, supply-chain disruption, labour disputes, governmental orders, utility failure, or carrier delay.

19. Changes to these Terms

We may update these Terms. The "Last updated" date reflects the current version. We will give notice of material changes by email or a prominent notice on the Site before they take effect. Changes do not apply retroactively to a dispute already notified under Section 17. The Terms that apply to an order are the ones in effect on the date you placed it. Continued use of the Site after changes take effect constitutes acceptance.

20. Termination

We may suspend or close your access or account at any time for violation of these Terms or suspected fraud or abuse. Sections that by their nature should survive — including Sections 10, 11, 13, 14, 15, 16, 17, and 22 — survive termination.

21. Electronic communications and electronic signature

You consent to receive communications from us electronically, including transactional emails about your orders and subscription. By clicking to place an order or start a subscription, you are providing a legally binding electronic signature and agree that it has the same effect as a handwritten signature. Agreements, notices, and disclosures delivered electronically satisfy any legal requirement that they be in writing. You may withdraw this consent by closing your account; we cannot process orders without it.

Marketing emails are separate and optional — you may unsubscribe at any time using the link in any marketing email. Unsubscribing from marketing does not stop transactional messages about orders you have placed.

22. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy, Refund and Returns Policy, Shipping Policy, Subscription Terms and Cancellation Policy, Promotions, Gift Card, and Referral Terms, Cookie Policy, and Reviews and User Content Policy, are the entire agreement between you and Anaerobic Coffees LLC.

Severability. If any provision is found invalid, the rest remains in effect.

No waiver. Our failure to enforce a right is not a waiver of it.

Assignment. You may not assign your rights without our written consent. We may assign ours without restriction.

Notices. Notices to us go to contact@anaerobic-coffees.com. Notices to you may be sent to the email on your account or posted on the Site.
